ADA Transition & Title VI Implementation Plans

GrantSmith Assists Communities with ADA/Title VI Plans

Whether through a contract to perform work or provide professional services or as part of a grant or award for the community, communities that receive federal funding are required to be in compliance with Title VI & Americans with Disabilities Act (ADA) nondiscrimination and accessibility requirements.

An American with Disabilities Act (ADA) Transition Plan is a living document that assesses the accessibility of a community's public facilities, programs and services and includes self-evaluations to document its compliance efforts and outline a course for improvements. If a community receives federal aid, they must meet the requirements of Title I and Title II of the Americans with Disabilities Act. Title I of the ADA prohibits private employers, state and local governments, employment agencies, and labor unions from discriminating against qualified individuals with disabilities in job application procedures, hiring, firing, promotion/demotion, compensation, and job training.

ADA Transition Plan:

  • Designate & traine ADA Coordinator, identified by name, with contact information

  • Develop and post a section 504 policy with public notice

  • Obtain ongoing public involvement

  • Complete a self-evaluation of all public facilities & programs as applicable and prioritize & budget for barrier removal.

  • Develop a transition plan

  • Design & build accessible facilities & programs, including provision of auxiliary aides.

  • Have a complaint process, form and grievance procedure

  • Review & monitor compliance

  • Train staff in accessibility requirements

Title VI Implementation Plan:

  • Have a Title VI Coordinator / Program Manager who has received training

  • Develop and post a Nondiscrimination Policy

  • Sign the Assurances of Nondiscrimination & include required appendices in contracts

  • Train Staff regularly

  • Have a Grievance Procedure, form and a Complaint Log

  • Have both an Annual Title VI Implementation Plan and an Annual Goals & Accomplishments Report

  • Monitor Subrecipients for Compliance if applicable, or state that this is not applicable

  • Have a Public Involvement Plan (including EJ & LEP segments of your community)
